Service Description
Nevada Pest Control provides professional pest management services for residential and commercial properties throughout the State of Nevada. Our services include, but are not limited to, inspection and identification of pest activity, implementation of integrated pest management programs, chemical and non-chemical treatment applications, exclusion services, ongoing monitoring, and follow-up visits as specified in individual service agreements. Treatments target common Nevada pests including scorpions, black widows, desert recluse spiders, bark scorpions, roof rats, pack rats, pigeons, cockroaches, ants, termites, bed bugs, and other regional pest species. Service frequency, treatment methods, and covered areas are determined by the written service agreement executed between Nevada Pest Control and the client prior to commencement of services. We utilize environmentally responsible products and techniques that comply with all applicable federal and state regulations, including those administered by the Nevada Department of Agriculture and the Structural Pest Control Section.
No Guarantee or Warranty
Nevada Pest Control makes no express or implied guarantees regarding the complete elimination of pests from any treated property. Pest management is influenced by numerous variables outside our reasonable control, including but not limited to: surrounding environmental conditions, neighboring property infestations, construction defects, weather events, client adherence to preparation and prevention recommendations, and the biology and behavior of target pest species. Desert-adapted pests common to Nevada, particularly scorpions and certain spider species, may persist despite thorough treatment due to their resilient nature and the region's favorable climate. All services are performed using commercially reasonable efforts based on industry standards. Results may vary between properties and treatment cycles. Nevada Pest Control does not warrant that treated premises will remain pest-free for any specific duration, and no refund shall be issued based solely on the continued presence of pests following treatment. Any retreatment services shall be provided according to the terms of the applicable service agreement.
User Responsibilities
Clients bear significant responsibility for achieving optimal pest management outcomes. You must provide accurate and complete information regarding pest history, property conditions, previous treatments, known allergies or sensitivities, and presence of children, pets, or vulnerable individuals prior to service commencement. Clients must ensure unrestricted access to all areas requiring treatment, including attics, crawl spaces, storage areas, and exterior perimeters. Interior preparation requirements—such as removing items from cabinets, vacuuming, or washing linens—must be completed as directed before scheduled treatments. Following application, clients must adhere to all re-entry intervals, ventilation instructions, and safety precautions provided by technicians. Failure to maintain proper sanitation, eliminate conducive conditions such as standing water or harborage sites, or implement recommended exclusion measures may compromise treatment efficacy. Clients must promptly report pest activity between scheduled visits and must not interfere with bait stations, monitoring devices, or other treatment materials installed by Nevada Pest Control personnel. Unauthorized modification or removal of treatment applications voids any obligation for complimentary follow-up services.
Limitation of Liability
To the maximum extent permitted by Nevada law, Nevada Pest Control's aggregate liability arising from or relating to any service, whether in contract, tort, strict liability, or otherwise, shall not exceed the total amount paid by the client for the specific service giving rise to the claim during the twelve-month period preceding the event. Under no circumstances shall Nevada Pest Control be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to property damage, personal injury, loss of profits, emotional distress, or business interruption, even if advised of the possibility of such damages. This limitation applies regardless of whether damages result from our negligence, breach of warranty, or any other cause of action. Clients assume all risk of damage to personal property, landscaping, or structures that may occur during treatment applications, except where caused by our gross negligence or willful misconduct. Nevada Pest Control is not responsible for allergic reactions, sensitivities, or health conditions exacerbated by treatment products when such products are applied in accordance with manufacturer specifications and regulatory requirements.
Intellectual Property
All content, materials, and intellectual property associated with Nevada Pest Control's business operations remain our exclusive property. This includes but is not limited to our business name, logos, service marks, trade dress, proprietary treatment protocols, technical documentation, website content, marketing materials, photographs, videos, and customer data compilations. No license or right to use any Nevada Pest Control intellectual property is granted by virtue of receiving our services or accessing our materials. Clients may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Nevada Pest Control materials without prior written consent. Service reports, treatment diagrams, and recommendations provided to clients are intended solely for the client's personal, non-commercial use at the specified property and may not be transferred to third parties, used for competitive purposes, or relied upon by subsequent property owners without our express authorization.
Governing Law
These Terms of Service and any disputes arising from or relating to services provided by Nevada Pest Control shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles. Any legal action, proceeding, or dispute resolution involving Nevada Pest Control shall be brought exclusively in the state or federal courts located in Clark County, Nevada. Clients irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection to jurisdiction or venue on the grounds of inconvenient forum. The provisions of the Nevada Uniform Arbitration Act may apply to certain disputes as specified in individual service agreements. If any provision of these terms is found invalid or unenforceable under Nevada law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
Changes to Terms
Nevada Pest Control reserves the right to modify, amend, or update these Terms of Service at any time and for any reason, in our sole discretion. Material changes shall become effective thirty days after posting revised terms to our official website or upon delivery of written notice to clients with active service agreements, whichever occurs first. Continued use of our services following the effective date of any modifications constitutes acceptance of the revised terms. Clients are responsible for reviewing these terms periodically to remain informed of updates. If any modification is unacceptable to you, your sole remedy is to terminate service in accordance with your service agreement provisions. Changes shall not apply retroactively to disputes or events that arose prior to the effective date of modification. Non-material changes, including corrections of typographical errors or clarifications of existing provisions, may take effect immediately upon posting.
